Terms of Service

These Terms govern your use of the storefront operated by Lazurd for Ready Meals Preparations (Commercial Registration No. 338576, State of Kuwait) at this website (the "Storefront") and the purchase of any product or service through it. By placing an order you confirm that you have read, understood, and accept these Terms.

1. Who we are

The Storefront operates under the trading name Daily by Lazurd. All sub-brands shown on this Storefront — Lazurd Classic, OYA, Al Radda Organic Bakery, Lazurd At Your Table, Shaikha Dates, and I Love Food — are trading names operating under Lazurd's main Commercial Registration No. 338576, in line with Commercial Law No. 68 of 1980 (Articles 61–95, governing trade names) and Decree-Law No. 1 of 2025 on Combating Commercial Concealment. All orders are fulfilled and supported by Lazurd as a single legal entity.

2. Eligibility

You must be at least 18 years old, or accessing the Storefront with the consent and supervision of a guardian, to place an order.

3. Electronic contract formation

Under the Electronic Transactions Law No. 20 of 2014 (Articles 3 and 4), orders placed and confirmed through this Storefront constitute binding contracts with the same legal force as paper contracts. By submitting an order, you give the consent required under Article 4 to transact electronically.

A contract is formed only when you receive an order-confirmation email or message from us. We may refuse or cancel any order at our discretion before that point (for example, for pricing errors, suspected fraud, capacity limits, or items the courier cannot safely deliver).

4. Prices, taxes, and invoices

All prices are displayed in Kuwaiti Dinar (KWD). As required by Article 13 of Consumer Protection Law No. 39/2014, the price of each item is clearly displayed on its product page. No Value Added Tax (VAT) currently applies in the State of Kuwait. Invoices are issued in Arabic and English (Article 15, Law 39/2014).

5. Product information and accuracy

We aim for accurate descriptions, photography, nutritional information, ingredients, and allergen declarations on every product page, in line with Public Authority for Food and Nutrition (PAFN, Law No. 112 of 2013) labelling requirements. Minor batch-to-batch variation can occur for handmade items.

6. Allergens

Our products are prepared in facilities that handle nuts, peanuts, sesame, dairy, eggs, gluten, soy, and other common allergens. Allergen information is provided on each product page. If you have a severe allergy, please contact us before ordering. Lazurd is not liable for allergic reactions caused by failure to read product allergen information.

7. Payment

Accepted methods: KNET, Visa, Mastercard, Apple Pay, Google Pay, processed through Central-Bank-of-Kuwait-licensed payment providers. Payment is taken at the time of purchase.

8. Delivery

Delivery is governed by our Shipping Policy. We deliver within the State of Kuwait only.

9. Refunds and complaints

See our Refund & Return Policy. The perishable-goods exception applies under Article 10 of Law No. 39/2014 and Chapter Four of Decree-Law No. 10/2026: prepared and perishable food is non-returnable except where spoiled, expired, incorrect, or non-conforming on arrival.

10. Customer conduct

You agree not to misuse the Storefront, attempt unauthorised access, post unlawful content in reviews, or engage in fraudulent payment behaviour. We may suspend accounts that violate these Terms.

11. Intellectual property

All brand names, logos, recipes, photography, copy, and design on this Storefront are the property of Lazurd or its licensors. You may not reproduce or use them commercially without written permission.

12. Liability

To the extent permitted by Kuwaiti law, Lazurd's liability for any single order is limited to the price you paid for the affected items. We are not liable for indirect losses such as lost profits or consequential damages. Nothing in these Terms excludes liability that cannot lawfully be excluded under Kuwaiti law.

13. Force majeure

We are not liable for delay or non-performance caused by events beyond our reasonable control (natural events, government action, public-health restrictions, courier failure, infrastructure outage).

14. Governing law and jurisdiction

These Terms are governed by the laws of the State of Kuwait. The Kuwait Courts have exclusive jurisdiction over any dispute. Consumer complaints may be filed with the Consumer Protection Department of the Ministry of Commerce and Industry (hotline 135 / Sahel app).

15. Changes to these Terms

We may update these Terms from time to time. The version in force at the time of your order applies. We will publish material changes on this page.

16. Digital commerce regulation

Lazurd operates in compliance with applicable Kuwaiti laws, including Consumer Protection Law No. 39/2014, Electronic Transactions Law No. 20/2014, Decree-Law No. 1 of 2025 on Combating Commercial Concealment, and (upon its entry into force in 2026) Amiri Decree-Law No. 10 of 2026 on Regulating the Digital Commerce Sector.

شروط الخدمة

تحكم هذه الشروط استخدامك للمتجر الذي تُديره شركة لازورد لتحضير الوجبات الغذائية الجاهزة (رقم السجل التجاري ٣٣٨٥٧٦، دولة الكويت) على هذا الموقع («المتجر»)، وشراء أي منتج أو خدمة من خلاله. بتقديم الطلب تُؤكّد أنك قرأت هذه الشروط وفهمتها ووافقت عليها.

١. من نحن

يُشغَّل المتجر تحت الاسم التجاري «ديلي باي لازورد». جميع العلامات الفرعية الظاهرة في المتجر — لازورد كلاسيك، أويا، الردة للمخبوزات العضوية، لازورد على طاولتك، تمور شيخة، أنا أحب الأكل — هي أسماء تجارية تعمل تحت السجل التجاري الرئيسي لـ«لازورد» (٣٣٨٥٧٦)، بما يتوافق مع قانون التجارة رقم ٦٨ لسنة ١٩٨٠ (المواد ٦١–٩٥ تنظيم الأسماء التجارية) والمرسوم بقانون رقم ١ لسنة ٢٠٢٥ بشأن مكافحة التستر التجاري. جميع الطلبات تُنفَّذ وتُدعَم بواسطة لازورد ككيان قانوني واحد.

٢. الأهلية

يجب أن تكون في سن الثامنة عشرة أو أكثر، أو أن تستخدم المتجر بموافقة وإشراف وليّ أمر، لتقديم طلب.

٣. تكوين العقد الإلكتروني

بموجب قانون المعاملات الإلكترونية رقم ٢٠ لسنة ٢٠١٤ (المادتان ٣ و٤)، فإن الطلبات المُقدّمة والمؤكَّدة عبر هذا المتجر تُشكّل عقوداً مُلزِمة لها نفس القوة القانونية للعقود الورقية. بتقديم الطلب فأنت تمنح الموافقة المطلوبة بموجب المادة ٤ للتعامل إلكترونياً.

لا يُعدّ العقد قائماً إلا عند استلامك بريداً إلكترونياً أو رسالة بتأكيد الطلب. يحق لنا رفض أو إلغاء أي طلب قبل ذلك (مثلاً: أخطاء التسعير، الاشتباه بالاحتيال، حدود الطاقة، أو منتجات لا يمكن توصيلها بأمان).

٤. الأسعار والضرائب والفواتير

جميع الأسعار بـ الدينار الكويتي (د.ك). كما تشترط المادة ١٣ من قانون حماية المستهلك رقم ٣٩/٢٠١٤، يُعرض سعر كل صنف بوضوح في صفحته. لا توجد ضريبة قيمة مضافة (VAT) في دولة الكويت حالياً. تُصدَر الفواتير بالعربية والإنجليزية (المادة ١٥ من قانون ٣٩/٢٠١٤).

٥. معلومات المنتج ودقّتها

نحرص على دقة الأوصاف والصور والمعلومات الغذائية والمكوّنات وتصاريح الحساسية في كل صفحة منتج، وفقاً لاشتراطات الإعلان والملصقات لدى الهيئة العامة للغذاء والتغذية (قانون ١١٢/٢٠١٣). قد تحدث اختلافات بسيطة بين الدفعات للمنتجات اليدوية.

٦. مسببات الحساسية

تُحضَّر منتجاتنا في منشآت تتعامل مع المكسرات والفول السوداني والسمسم ومنتجات الألبان والبيض والغلوتين والصويا وغيرها. معلومات الحساسية مذكورة في صفحة كل منتج. إذا كنت تعاني من حساسية شديدة، تواصل معنا قبل الطلب. لا تتحمّل لازورد مسؤولية أي رد فعل تحسسي ناتج عن عدم قراءة معلومات الحساسية.

٧. الدفع

الوسائل المقبولة: كنت، فيزا، ماستركارد، آبل باي، جوجل باي، عبر مزوّدي دفع مرخّصين من بنك الكويت المركزي. يُحصَّل الدفع وقت الشراء.

٨. التوصيل

يخضع التوصيل لـ سياسة الشحن. نوصّل داخل دولة الكويت فقط.

٩. الاسترداد والشكاوى

راجع سياسة الاسترداد والإرجاع. يُطبَّق استثناء السلع القابلة للتلف بموجب المادة ١٠ من قانون رقم ٣٩/٢٠١٤ والفصل الرابع من المرسوم بقانون رقم ١٠ لسنة ٢٠٢٦: الأطعمة المعدّة والقابلة للتلف غير قابلة للإرجاع باستثناء حالات التلف أو انتهاء الصلاحية أو الخطأ أو عدم المطابقة عند التسليم.

١٠. سلوك العميل

تُوافق على عدم إساءة استخدام المتجر أو محاولة الوصول غير المصرّح به أو نشر محتوى غير قانوني في التقييمات أو القيام بسلوك دفع احتيالي. يحق لنا تعليق الحسابات المخالفة.

١١. الملكية الفكرية

جميع أسماء العلامات والشعارات والوصفات والصور والنصوص والتصاميم في هذا المتجر هي ملك لشركة لازورد أو مرخّصيها. لا يجوز نسخها أو استخدامها تجارياً دون إذن خطي.

١٢. المسؤولية

إلى الحد الذي يسمح به القانون الكويتي، تقتصر مسؤولية لازورد عن أي طلب على المبلغ المدفوع للمنتجات المتأثرة. لا نتحمّل أي خسائر غير مباشرة كالأرباح الفائتة أو الأضرار التبعية. ولا يستثني هذا أي مسؤولية لا يمكن استبعادها قانوناً في الكويت.

١٣. القوة القاهرة

لا نتحمّل المسؤولية عن التأخير أو عدم التنفيذ بسبب أحداث خارجة عن سيطرتنا المعقولة (ظواهر طبيعية، قرارات حكومية، قيود الصحة العامة، تعطّل شركات التوصيل، انقطاع البنية التحتية).

١٤. القانون والاختصاص

تخضع هذه الشروط لقوانين دولة الكويت. للمحاكم الكويتية الاختصاص الحصري في أي نزاع. يمكن تقديم شكاوى المستهلك إلى إدارة حماية المستهلك بوزارة التجارة والصناعة (الخط الساخن ١٣٥ / تطبيق سهل).

١٥. تعديل الشروط

يحق لنا تحديث هذه الشروط من حين لآخر. تسري النسخة المعمول بها وقت تقديم طلبك. سننشر أي تعديلات جوهرية على هذه الصفحة.

١٦. تنظيم التجارة الرقمية

تعمل لازورد بما يتوافق مع القوانين الكويتية المعمول بها، بما في ذلك قانون حماية المستهلك رقم ٣٩/٢٠١٤، وقانون المعاملات الإلكترونية رقم ٢٠/٢٠١٤، والمرسوم بقانون رقم ١ لسنة ٢٠٢٥ بشأن مكافحة التستر التجاري، و(فور دخوله حيز التنفيذ في ٢٠٢٦) المرسوم بقانون رقم ١٠ لسنة ٢٠٢٦ بشأن تنظيم العمل بقطاع التجارة الرقمية.
